Ravnsborg Created Politically Useless Political Action Committee

Jason Ravnsborg’s job prospects don’t look good. He’s a liar. He’s a killer. He’s the only public official ever impeached in South Dakota. He’s a bad lawyer, and he’ll probably have his law license suspended for a year or so.

So what’s he going to do to pay his mortgage? Apparently follow the model of Annette Bosworth, who got more votes and a crap-ton more campaign cash than Ravnsborg in their failed 2014 U.S. Senate bids, and fleece vulnerable voters with a political action committee that will provide him with an income stream until he can come up with his next viable medicine show.

Back in February, Ravnsborg created a PAC called “$99 for Freedom” (a phrase possibly lifted from a juvenile fiction book, which would be appropriate, since Ravnsborg’s political aspirations have all along been a juvenile fiction). Ravnsborg claimed in his filing that the purpose of his PAC is to “Elect Conservative Candidates”.

The only likely use of money sent to a PAC run by Jason Ravnsborg would be to provide Ravnsborg himself with a paycheck, because, really, what rational candidate would publicly accept a check from Ravnsborg? The only political value any support from Jason Ravnsborg would have would be for his endorsees’ opponents who would gladly catch news that their adversaries have taken money from $99 for Freedom and rush to Twitter to say, “My opponent has the endorsement of an impeached Attorney General who killed a man and lied about it!” The only way Jason Ravnsborg could use his PAC to help elect conservative candidates would be to scam liberal donors, drain their donations, and then donate to liberal candidates to generate embarrassing headlines for their campaigns.

Ravnsborg’s February filing listed his PAC email address as ninetyninedollarsforfreedom@yahoo.com. The Yahoo address suggests he hadn’t invested in a dedicated website yet, and Google searches this morning show no apparent Web presence. But watch for future filings, and let’s see how many people are foolish enough to give Ravnsborg money, how many are foolish enough to take it, and how much the pittance he may raise Ravnsborg may just stuff in his own pocket for “salary” and “consulting”.

This man has always been clueless, he has a demonstrated history of making very poor decisions and then doubling down on them.

  2. WillyNilly 2023-07-14 10:59

He is the first SD government official to be impeached. If the legislature had any spine at all, they would be checking out the governor’s office.

  3. Arlo Blundt 2023-07-14 11:49

In politics as in baseball, “Its not over until its over.” Ravnsborg is still alive and able to lick a stamp. There are folks out there, as evidenced by the billboard north of Madison, who will willingly back a political personality temporarily out of the limelight. Jason has a plan!!!

  4. Bob Newland 2023-07-14 14:14

I think there are a significant number of potential and actual candidates who would love a donation even from Ravvensburg (as his own lawyer addressed him repeatedly during the impeachment hearing).

  5. Mike Zitterich 2023-07-14 18:57

The best, and most constitutional Attorney General we ever had in a long, long time. I would support the PAC cause I know why he is doing it, and the reason he is doing it, and as a CITIZEN of this State, he has the right to lobby, and help campaign for strong constitutional candidates, initiatives, etc. We got to remove ALL RINO republicans out of the legislature, and keep Democrats from getting in. Restore the Republic.

He should have never been impeached, nor removed anyways…

  6. Mike Zitterich 2023-07-14 19:01

The motor vehicle accident was just that, an accident, where a man was walking down a dark lit highway, out of his mind. I feel sorry for the family, but you do not lose your job over an accident. NOW every legislator with a traffic ticket can be impeached. Shame on this corrupted legislature. Mr Boever was just as at fault for the accident as the other guy. This was just a withhung by the powers at large cause the former A.G was going hard after corrupt politicians.

There are no accidents. Only an incel like Mr. Ravnsborg is knows how many phones he’s had or has now just as Denny Sanford knows.

$20 says Jason Ravnsborg is hiding a reality that makes Bill Janklow’s look like a sweet biopic.

  11. Mike Zitterich 2023-07-14 21:07

A COURT found him innocent…you people think he should not be a free man, but yet, a medicated man was highly walking down a road, to get a truck that he himself crashed, drove off a road, damaging someones property, under the law, even Mr. Boever would have been guilty in his own incident. NO ONE goes to prison for causing a death of a person while diving on a roadway. Therefore, it was ALL POLITICALLY DRIVEN by a left wing democrat, Tom Daschle Supporter cause they did not like the policies coming out of the A.G’s OFFICE between 2018-2022. I repeat, NO ONE should have been impeached, removed, nor lose their livelyhood for an motor vehicle accident.

If there was a red flag law in South Dakota Jason Ravnsborg would swatted, court-martialed then join Rich Benda and Scott Westerhuis in state history.

Curt, yes Mike Z is for real. I also suspect he has been blocked from the SD War College blog as Larry Kurtz has been, which has only made the SDWC less interesting. He used to post a lot there which was very entertaining.

Meanwhile, one of the most hated and polarizing figures in South Dakota politics is throwing up his hands in desperation as Earth haters in his political party are preparing to burn down the Big Tent. At his blog, Dakota War College rotund Brookings blogger Pat Powers routinely smears principled conservatives who don’t bend the knee to the South Dakota Republican Party establishment.

Pernicious Pug Powers, who makes a stopped clock look like a smooth-running timepiece, salts his blog comment section with a seemingly infinite variety of aliases that threaten or jeer his political enemies including those in his own party then wonders why the SDGOP is headed for a rapid unscheduled disassembly and now he wants to bridge the divide?

  20. grudznick 2023-07-15 09:25

Mr. PP can indeed be more of a salty dog than this insaner fellow, Mr. Zitterich, as my close personal friend Lar points out.

Mr. Zitterich, tighten up your bloggings just a wee bit. You are starting to chub them up again.

  21. grudznick 2023-07-15 09:31

Mr. Zitterich, do you remember Congressman Janklow? He went to prison for driving on a roadway.

  22. Mike Zitterich 2023-07-15 13:57

Bill Janklow was also found drunk, and speeding also, both intentionally breaking the law….big difference.

The former Attorney General was NOT found to have intentionally caused, nor harm another motor vehicle driver or pedestrian. The court documents prove this. All that was learned was, that two men participated in a motor vehicle accident that night, and that the driver of the Ford Tauras was found to be be slightly more at fault to causing the damages that resulted from the incident itself, leading to the driver finally accpeting, and pleading a “No Contest” plea in the end, agreeing that he did in fact attest to, and pronounce that he participated in the incident..

There was never one witness, nor any testimony that could tie the ‘driver’ to any drinking of alcohol that night, and there no witness, nor traffic cop of which witnessed the driver speeding that night, nor does the evidence claim that the driver was speeding, therefore the state had no case.

Because of this, the State, nor no claimant cold bring forth vehicular homicide, nor could you bring forth 2nd Degree Manslaughter. Just as you cannot bring forth in any such motor vehicle incident 99.9% of the time any other time. NO ONE in this incident was guilty of any felony nor criminal intent.

The Attorney General should have never been on the hook for impeachment, nor should he had been removed, let alone barred from ever holding future office. The whole political debate was brought forward by Mr. Lee Schoenbeck and his crazy left wing side kicks cause they want to remove all “Conservative” and Constitutionalist from the legislature, let alone they are agaisnt anyone who stands in their way.

The fact is, Mr Boever if he had survived the incident, could have very easily been found guilty of the same class 2 offenses as Mr Ravsborg in his own traffic incident just 1 or 2 hours earlier as he to, was driving carelessly, most likely under the influence of alcohol or medication which led to him driving off the road, into the ditch, damaging someones property aka the haybarrell, which has a monetary value of at least $500 dollars.
He to, could have easily been found guilty of crossing the white line, let alone distracted driving as well. Does he lose his job as well? No.

Contrary to popular opinion, the motor vehicle incident was no different than any other accident that we see everyday, week, month of the year.

However, because of the actions stemming by the S.D Legislature – now any Legislator can be impeached and removed from simple class 2 misdeneanors stemming from a Traffic Accident. Sadly. The precedent has now been set, scary.

Most likely if Mr Boever’s relative, Mr. Nick Nemic had not been a huge Democrat supporter fiancier, lobbyist in the State, with huge ties to the likes of Tom Daschle, Lee Schoenbeck, and Tim Johnson, etc – this matter would not have been any more bigger than it should have been. It was made political by the far left, motivated establishment of both the republican party and democrats who control the powers in the State.

Regardless of how you feel about Jason Ravsnborg or not, any decent human being could tell that this was a political withhunt led by the most powerful people in the State cause the former A.G was going after the Governor, and the several established people in our government itself.

Watching the SDGOP splintering over Jason Ravnsborg is a most hopeful sign. It’s important to remember Joe Biden is Commander in Chief of the Us Armed Forces and could order Mr. Ravnsborg’s court-martial and dishonorable discharge if enough people lobbied the President.

  25. larry kurtz 2023-07-15 14:21

  27. Donald Pay 2023-07-15 15:05

Grudz is correct. Janklow’s defense in his criminal case involved impairment due to diabetes and his diabetes medication or lack thereof. Whether Janklow was ever over the blood alcohol limit when he was speeding in other instances, of course, is another matter. Janklow received special treatment from the highway patrol and other law enforcement.

  28. e platypus onion 2023-07-15 16:08

Ravnsborg was solely at fault. he was driving over the speed limit, fully off the traveled portion of the roadway and struck an innocent pedesstrian and killed him and then pulled a typical magat trick an d lied his ass off.

And Zitterich swallowed it, hook line and sinker with additional split shots attached.

  29. e platypus onion 2023-07-15 16:11

Mike Zitt , you are insaner than most.

Tom Daschle and Tim Johnson had nothing to do with the Ravnsborg impeachment, Mike Zitt. Stop with your crazy conspiracy nonsense. Nick Nemec is not a huge lobbyist with powerful ties. Good lord, where do you come up with this stuff?

If anything, I would say that Kristi Noem was the force that put in motion Ravnsborg’s impeachment. With her dreams of running for higher office, she wanted Ravnsborg out bad since he was nothing but trouble with all the negative publicity he was getting. She wanted nothing whatsoever to do with him and undoubtedly the press would have hounded her about it if he had not been impeached.
You best run along Zitt. I hear out yonder that Nemec gets might uptight when people are spewing gossip about him.

  32. leslie 2023-07-15 22:46

Zit’, wasn’t he “driving” (while likely digitally distracted), fully on the shoulder when he killed the pedestrian? Have you driven fully on the shoulder distracted, at full highway speed?

There isn’t ANY doubt about those road shoulder photographs. The AG dealt w/the 911 operator, and the sheriff obstructing evidence, and left the scene with the Taurus, after the violent death, with indisputable evidence inside the Taurus.

  33. Mike Zitterich 2023-07-16 00:03

Yep, I am insane according to some progressive democrat(s) cause I have a different opinion than them, I look at the facts:

    1) Fact, there was no proof that the driver was drunk, many people came forward during investigation to provide information that A.G does not drink, nor did he have alcohol the night of the accident;

    2) Fact. there is NO Proof that all four tires were across the white line, meanign, there can be no legit means to place the ford tauras all the way in the shoulder, meaning, if only the right side tires were over the line, quite normal for vehicles at night, the pedestrian may have been to close to the roadway…

    3) Fact. the vehicle computer recorded the top speed at the time of impact as being 67.3 mph, hardly speeding, let alone presented a case that driver was not acting in a reckless manner;

    4) Fact. the pedestrian had some degree of being under the influence of drugs/alcohol in his system…

    5) Fact. there was no witness to the accident, which makes this more or less a he said, she said situation…

    6) Fact. the cell phone was checked, and was proven that it had been locked prior to entering Highmore. For all we know, he may have been adjusting, turning on his phone to listen to, or check messages, etc, quite a common trait among many South Dakotans these days…

    7) Fact. the Pedestrian just hours earlier had careless driven his pick up across the white line, indirectly driving into the ditch hitting a haybarrell.

    8) Fact. with no proof of the driver being impaired, or under the influence due to witnesses coming foward, there can be no such means of brining forth Vehicular Homicide against the driver.

    9) Fact. with no proof of the driver reckless driving, no witnesses, no traffic cop saw prior to accident, ther can be NO Class 2 Misdemeanor brought against the driver in this specific situation.

    10) Fact. It is hearsay, that the driver may have or may not have seen any glasses in his vehicle as claimed by the media, the classes may have, or may not have been in the car before or after the accident…

    11) Fact. Pedestrians are hit by motor vehicles often on South Dakota roads often during a coure of a year, NO DRIVER often does NOT go to prison, nor gets convicted of Vehicle Homicide or 2nd Degree Manslaugter 99% of the time…

    12) Fact. the Former A.G was heavily invetigating many of the Governor’s policies, actions, to determine whether or not she was acting constitutionally or not, which led to her so aggressively going after him, to get him removed from office, which allows her to appoint someone to the office of the A.G…

    13) Fact. the Establishment Wing of the Republican Party and Democrats wanted the A.G gone cause he steadily opposed much of his agenda, and was seen as a dentriment to their plan…

    14) Fact. Thanks to the Precedent set by the 2021-22 Legislature, now ANY LEGISLATOR can now be impeached and removed for a simple Class 1 or 2 Misdemeanor resulting from a Motor Vehicle Accident, so now we can pretty much go member by member and impeach just about EVERY MEMBER of the legislature today, since all of them at some point in their life has had a Class 1 or 2 Misdemeanor in their lifetime while driving on public roads, or have been involved in an accident at least once in their lives.

Yep. Cause I have a different opinion, and outlook of the entire matter, makes me insane, but thank god, popular opinion does not condemn people to prison, let alone convict people of crimes in America. “WE” are not a third world country which cast stones at people on a street corner.

I will stop shy of attacking anyone, or personally insulting everyone elses opinion, I will not stoop to your level of ignorance…

    $99 for Freedom!

  35. Mike Zitterich 2023-07-16 09:43

$99 Dollars for Freedom – a Political Action Committee established by former Attorney General Jason Ravnsborg is an attempt to call out the establishment, by promoting Freedom, Liberty, and the Constitution, and to be a thorn in the side of the Establishment. While the “Establishment” has voted to ban him from ever holding public office due to a motor vehicle accident, the Constitution protects his right to maintain his “Voice” in Statewide Politics.
“Every person may freely speak, write and publish on all subjects, being responsible for the abuse of that right. In all trials for libel, both civil and criminal, the truth, when published with good motives and for justifiable ends, shall be a sufficient defense. The jury shall have the right to determine the fact and the law under the direction of the court” – Article 6, Section 5
By organizing, and giving to the people the right to “voice” their opinion, expressing themselves in the political arena, the “establishment” will now be forced to contend with those who they oppose, let alone, this may in fact maintain the fact, that a huge majority of the ‘people’ in the State do not, and will never agree with the majority opinion of the Legislature itself.
Freedom is defined by the state of not being imprisoned or enslaved, to which a person has the liberty of being physically unrestricted and able to move easily. The power or right to act, speak, or think as one wants without hindrance or restraint, is to maintain your voice in the absence of subjection to foreign domination or despotic government, while utilizing constitutionally protected right to form the state of not being subject to, or affected by limitations, while upholding, and enforcing your power of self-determination attributed to the will; the quality of being independent of fate or necessity, while being unrestricted by rules established by a political class of people of who bound themselves to a specific class of rules.
By forming the $99 For Freedom Political Action Committee, Jason Ravnsborg has the ability to tour the Free Republic of South Dakota, using his knowledge of how the select chosen established class of persons are choosing to operate the ‘state’, gaining the power, and the voice of those people outside that establishment who may feel, or the lack of, that the legislature does not speak for them.
As we live today, in a time, whereas the “Counties” are searching for a voice of reason, the $99 For Freedom P.A.C is now seen as giving to the Counties, that “voice” of which to unite under, in a question to adopt a resolution, an initiative, and a plan forward to help fight the corrupted, seemingly privileged class of citizens of whom hold powerful positions in the State Capitol today.
As the “Counties” today are seeking the means to express themselves, rallying behind a common theme, a common resolution, in order to make their voices heard, against a despotic government of which is made up of a system of which the ruler has unlimited power to oppress anyone who may rise up against its absolute power; the goal of the “Political Action Committee” seemingly is to give to the counties, that voice, the freedom to do so.
Much like Donald Trump’s – Save America P.A.C, the goal is to place on public trial, the established political deep state itself.
The legislature, led by the likes of Lee Schoenbeck, and his powerful money men, such as Pat Powers, may have banned Jason Ravnsborg from holding Public Office, however, it has not silenced him, nor stolen his voice, for he still has the right given to him to rally the people, unite the counties, change the Republican Party to be more of a “Group of Freedom Loving Individuals” willing to stand up, speak loudly, and willing to sacrifice themselves for the b better good of the “State” – of which is a Free Republic in itself.
As a friend has reminded me of:

“We should be thanking specific Groups of People for our Independence, and the Pastors, for they led us through our revolutionary period of time, led by our direct descendants who became the creators of our country and the originators of our Declaration of Independence and our Constitution. They were led by a class of people commonly known as the Scottish-Irish (or Ulster Irish) of whom were seen as deplorables by the crown, for they were the borderers of the day. They gave the British hell, thanks to their willing intent to show no allegiance to the King, but only to their klan or kinfolk, and were willing to fight to death to defend themselves. Best known as anti-authoritarians, as they believed they were born to fight and were instilled to never surrender, in order to defend our life, liberty, people, land, and honor. The Borderers – this is why they would not let that flag hit the ground – Never Surrender.” – Violet Reverie

Alcohol would remain in your system even after five hours, though just at 0.005 percent. It would take roughly five hours and 20 minutes for you to completely metabolize all of the alcohol you consumed and get back down to 0.00 percent. And that is just if you start at 0.08, which is right at the legal limit.Oct 9, 2018

From what I remember, Ravnsborg was not tested or asked about drinking until the next day.

  38. Eve Fisher 2023-07-16 12:55

e platypus onion, you are correct – the sheriff gave him a ride home and didn’t test him for alcohol until the next day. The victim had a flashlight, which was still on when the sheriff arrived. And the victim’s glasses were in Ravnsborg’s front seat, along with a whole lot of glass, but Mr. Ravnsborg swore he never saw anything come into the car, and that he just hit a deer.
Meanwhile, Mr. Z is having a very, very, very cranky day, that will convince none of us of the Sir Galahad level innocence of Mr. Ravnsborg.

  39. Mike Lee Zitterich 2023-07-16 14:26

Do you all give ALL drivers a bad time for involving themselves in a motor vehicle accident where someone gets hurt, or dies? If, not, then why beknown a man for this accident, when at least 20 times a year, a pedestrian is hit by a car and killed? I will tell you why, cause you all make it political, cause you are all Democrats who think Republicans are bad. The only republicans you support are “Left Leaning Republicans” I am not having a cranky day, I am just tired of all your hatrid for people all cause they carry an R behind their name, or not believe as you do. My own website has more respect than people think, mostly cause I report the news let alone honestly make an attempt to educate and inform people without putting a spin on it one way or the other. Until you can do that, everyone will see you as for what you are – Complainers.

I believe, Jason Ravnsborg established the PAC for one reason, to stay involved, help people express themselves to Government, help lobby for constitutional laws let alone to better organize people giving them more POWER in Pierre. None of the Legislators are doing this, nor do they take the time to meet with the citizens on a daily business. Jason Ravnsborg, despite the accident, has always done this, Meet directly with the people to talk to them, listen to them, and ask them for what they want to see done in Pierre.

I am not going to attack, or insult a man who wanst to do good for the State, reglardless of what people may or may not think of him.

NEVER GIVE IN, ALWAYS FIGHT, NEVER LET THE FLAG HIT THE GROUND, FIGHT UNTIL DEATH TO KEEP YOUR FREEDOM !!!!!

It’s understandable that you feel strongly, Mike Zitterich, about never giving up and always fighting to preserve freedom. While it is important to stand up for what you believe in there’s a better alternative perspective. Sometimes, giving in or compromising can lead to better outcomes and prevent unnecessary conflicts.

Instead of focusing solely on fighting, consider finding peaceful resolutions, negotiating, and fostering communication. It’s also essential to prioritize the well-being and safety of oneself and others. Fighting until death may not always be the most effective or sustainable approach to preserving freedom.

Frankly, Mike Zitterich, you come across as carrying an enveloping persecution complex with severe paranoid tendencies. Quite possibly schizophrenic.

The perpetual wailing and hand-wringing about every little thing that doesn’t align with their utopian fantasies. While I may not agree with their preposterous notions, there’s a begrudging understanding that they truly believe in their cause, no matter how misguided it is. I suppose their pitiful attempts at social justice and equality reveal a certain innocence, albeit irritatingly naive. But mark my words, sympathy is the last thing grudznick wants to offer these delicate souls, like Mr. Zitterich, who insist on seeing the world through rose-colored glasses. Bah!

Political ideology was a proven pattern of distracted driving for Ravnsborg “while … accessing an anti-Biden conspiracy-theory video, he was traveling 73.4 mph, which his speedometer would have registered as 75 to 78 mph [p. 36]. Ravnsborg used his work cellphone for 69% of his drive from Redfield to Highmore [p. 38].”

If even one in a thousand people are as deluded as Mike Z, willing to work extra hard to defend indefensible crimes just to boost the MAGA fantasy, then Ravnsborg can send a million Bosworthian fear-mongering letters and get a thousand donations that will pay for the mailing expense and cover his mortgage and groceries for a year. That’s the MAGA scam that Boswroth practices before MAGA got its name and that now is Ravnsborg’s only viable path for supporting himself.

Doodling on his phone all the way home from Redfield wasn’t an accident.

Speeding and driving on the shoulder wasn’t an accident.

Lying to the police and the public wasn’t an accident.

The Legislature impeached an convicted Jason Ravnsborg to hold im accountable for bad things he chose to do, choices he made that disqualifying him from public office.

Besides, Jason Ravnsborg was as ineffective as Attorney General as he was as attorney private. He was so bad, he lost to me in court three times.

  60. Mike Zitterich 2023-07-17 15:05

SHOULD WE AMEND OUR VEHICULAR HOMICIDE TO GRANT THE “STATE” MORE POWER OVER OUR RIGHTS?

There are some within our “State” who believe our Vehicular Homicide Statute does not go far enough in granting to the “State”, more power in bringing the felony charge in matters of Motor Vehicle incidents. Some believe, limiting the felony charge to alcohol use or drug use is restrictive on the government.

To answer the question fully, let’s take a look at what the statute says, in relation to all public matters of motor vehicle incidents on the public roadways.

Any person who, while under the influence of alcohol, drugs, or substances in a manner and to a degree prohibited by § 32-23-1, without design to effect death, operates or drives a vehicle of any kind in a negligent manner and thereby causes the death of another person, including an unborn child, is guilty of vehicular homicide. Vehicular homicide is a Class 3 felony. In addition to any other penalty prescribed by law, the court shall order that the driver’s license of any person convicted of vehicular homicide be revoked for a period of not less than ten years from the date sentence is imposed or ten years from the date of initial release from imprisonment, whichever is later. In the event the person is returned to imprisonment prior to the completion of the period of driver’s license revocation, time spent imprisoned does not count toward fulfilling the period of revocation. – S.D.C.L 22-16-41

Keep in mind, what homicide is, and what it is not, and how it can be applied to the situation of driving on our public roads in all traffic accidents involving the death of another person, unborn baby, a bicyclist, and a pedestrian…

Homicide is first defined under S.D.C.L 22-16-15, and by our own law, Homicide is manslaughter in the first degree if perpetrated:
Without any design to effect death, including an unborn child, while engaged in the commission of any felony other than as provided in § 22-16-4(2)
    Without any design to effect death, including an unborn child, and in a heat of passion, but in a cruel and unusual manner;
Without any design to effect death, including an unborn child, but by means of a dangerous weapon
Unnecessarily, either while resisting an attempt by the person killed to commit a crime or after such attempt has failed
In order for the “State” to bring forth the felony charge of Homicide in the 1st Degree, it must first prove that the intent to commit a crime has occurred. (1) If perpetrated without authority of law and with a premeditated design to effect the death of the person killed or of any other human being, including an unborn child, or (2) If committed by a person engaged in the perpetration of, or attempt to perpetrate, any arson, rape, robbery, burglary, kidnapping, or unlawful throwing, placing, or discharging of a destructive device or explosive.

No person may be convicted of murder or manslaughter, or of aiding suicide, unless the death of the person alleged to have been killed, and the fact of the killing by the accused are each established as independent facts beyond a reasonable doubt.

And because of this rule, the prosecutor has to develop a separate cause, based in facts, and in law, that the “perpetrator” was first engaged in an activity totally separate, and in lieu of committing a crime, of which would lead to the innocent killing of another human life, leading to, and resulting in homicide.

A Motor Vehicle Incident, simply does not fit this definition, as anyone knows, the good majority of people do not get behind the wheel with the intent to cause a crime, needless to say a felony, they are simply getting behind the wheel to drive to their next destination, where anything that may occur while on the roadway, occurs indirectly of any such actions of the driver themselves.

Under South Dakota law, which does a fairly good job at protecting the rights of both the accused, and much as it stands in defense of life, liberty, justice, and prosperity, there can only be two possible ‘acts’ that present a case of where a “Driver” intentionally got behind the wheel with the intent of killing a human life.

Manslaughter in the Second Degree – any reckless killing of one human being, including an unborn child, by the act or procurement of another which, under the provisions of this chapter, is neither murder nor manslaughter in the first degree, nor excusable nor justifiable homicide, is manslaughter in the second degree.
Vehicular Homicide – any person who, while under the influence of alcohol, drugs, or substances.

Under the Motor Vehicle Code, “reckless driving” is defined as any person who drives any vehicle upon a highway, alley, public park, recreational area, or upon the property of a public or private school, college, or university carelessly and heedlessly in disregard of the rights or safety of others, or without due caution and circumspection and at a speed or in a manner so as to endanger or be likely to endanger any person or property, is guilty of reckless driving.

In order to bring forth the reckless driving charge, the State must present proof of, evidence of the ‘driver’ was already convicted or witnessed of violating another statute such as a speeding violation, no tail lights, careless driving, driving impaired, etc. Meaning, the ‘facts of’ must show clear evidence that the driver’s actions that day, led to the result of killing an innocent human being. There has to be a witness to, the facts must add up, and the mode of intent must be there first, prior to any such charge of Second Degree Manslaughter be presented to the judge and jury. Without it, there can be no ‘criminal charge’.

And second, there is the Vehicular Homicide Charge, which the State is not allowed to present to the judge or jury where there was no original intent to harm, or threaten, or kill the innocent human life, which has to occur first, before presenting a criminal intent to injure, harm, and kill another human life.

And under S.D.C.L 32-23-1, we find the ‘intent’ of getting behind the steering wheel, of which can bring forth Vehicular Homicide, the scope is limited to:

There is 0.08 percent or more by weight of alcohol in that person’s blood as shown by chemical analysis of that person’s breath, blood, or other bodily substance
Under the influence of an alcoholic beverage, marijuana, or any controlled drug or substance not obtained pursuant to a valid prescription, or any combination of an alcoholic beverage, marijuana, or such controlled drug or substance
Under the influence of any controlled drug or substance obtained pursuant to a valid prescription, or any other substance, to a degree which renders the person incapable of safely driving
Under the combined influence of an alcoholic beverage and or any controlled drug or substance obtained pursuant to a valid prescription, or any other substance, to a degree which renders the person incapable of safely driving
Under the influence of any substance ingested, inhaled, or otherwise taken into the body as prohibited by any person who intentionally ingests, inhales, or otherwise takes into the body any substance, except alcoholic beverages as defined as – distilled spirits, wine, ciders, and malt beverages – for purposes of becoming intoxicated, unless such substance is prescribed by a practitioner of the medical arts lawfully practicing within the scope of the practitioner’s practice, whereas further, any person who possesses, possesses with intent to distribute, sells, or distributes a substance knowing that it is to be used in violation.
Do you now see, where, and how the “State” can and cannot bring forth any of these ‘criminal charges’ against any such “motor vehicle driver” in times of a motor vehicle incident where an innocent may have been injured, harmed, or killed in the incident itself?

Something, or some activity has to have occurred prior to the injury, or death of another, which then defines the nature of the death itself. Without it, all “incidents” on our public roadways are best defined as “Accidents” and the causing of an injury, personal harm, or death is the indirect result of the incident.

In South Dakota all incidents that occur on our public highways, streets, roads are to be deemed an accident, less under further investigation, it is evidence of, witnessing of, or testimony of prior violations of law that more directly led to the personal harm, injury, death of another human life.

An Accident is nothing more than an unforeseen and unplanned event or circumstance, leading to an unfortunate event resulting especially from carelessness or ignorance, which leads to an unexpected event happening, causing loss or injury which is not due to any fault or misconduct on the part of the person injured but for which legal relief may be sought and used euphemistically to refer to an uncontrolled or involuntary act or instance of urination or defecation, describing an event which was not planned or intended.

Because the means of making it very difficult for the prosecutor, let alone the State to bring forth sufficient proof of, or facts of, 99% of all motor vehicle accidents in South Dakota are deemed an accident, leading to the best possible outcome sought being for nothing more than civil damages.

And civil damages are defined under South Dakota “Trade Regulation” under Title 37, Chapter 24, Section 31:

Any person who claims to have been adversely affected by any act, shall be permitted to bring a civil action for the recovery of actual damages suffered as a result of such act or practice leading to unexpected expenses caused by the incident itself such as – property damages, medical expenses, funeral costs, loss of income in foreseeable future, etc.

Before the “State” can bring forth any criminal charge of Vehicular Homicide, simply put – there must be evidence of, testimony of, a traffic violation that was first, witnessed prior to the incident, which creates the facts, of which then can be used to bring forth proof of, let alone the law to convict a driver of a criminal act of passion, or neglect while operating a motor vehicle on our public roads.

Some have stated they want to ‘amend’ state laws to add to Negligent Homicide felony as a possible means of prosecuting negligent drivers on the roads.

But do we want to give the “State” that much power, since negligence is oftentimes too broad of a term, leading to allowing the “government” to apply it to a wide array of instances, which can be used against any such person, or driver on public roads.

Negligence is a failure to behave with the level of care that someone of ordinary prudence would have exercised under the same circumstances. The behavior usually consists of actions, but can also consist of omissions when there is some duty to act a certain way.

Giving to government this expected wide, extreme power to utilize any such ‘action’ or ‘disability’ to bring forth such a felony charge while operating a motor vehicle, would allow that same government to convict you of a felony for any distraction (sun, radio, children, sign, building, the moon, a train, etc) in the case of any such motor vehicle incident, meaning, that the sun can now be used in such manner to show you were negligent in your driving activity.

Do we want to give the government this much power over us?

DFP has that effect on people.)

Is there any evidence to back up the claim that Ravnsborg put more emphasis on child trafficking and that that emphasis resulted in reducing child trafficking?

I’m not aware of Ravnsborg leading any charge to hold the federal government accountable for any genuine wrongdoing; my understanding is that Ravnsborg simply signed on to any and every lawsuit of the day from out-of-state AGs and added no substantive heft to any of those suits. Ravnsborg never went to the Supreme Court. Ravnsborg never won a big case. Marty Jackley at least went to Washington and won us more sales tax dollars (oh, darn—a victory for taxing and spending).

Ravnsborg didn’t do much but kill a man, lie about it, and abuse his office in his rank attempt to avoid accountability for his actions. Ravnsborg has no personal political power left to make his PAC worthwhile. Money donated to Jason’s RAC is money thrown down a hole: no one will want to take it, and Jason will just have a pot of cash he can use to pay for a new car.

Yes Cory there is, or at least was before he was removed, he had created the “States” first database, and was working on making know all children of whom was kidnapped, stolen, trafficked in or out of the State. I do believe now, that little girl Serenity was ‘trafficked” out of the State, but we do not know, nor understand how it occurred.

Yes, the Former Attorney General had put in place a database to help Tribal Governments work with the State to help defend their own people, both women and children from being trafficked and protected by those who wished to do them harm, mostly sex crimes, kidnapping crimes. This database still up today, was established by Ravnsborg, himself, who was actually reaching out to the FEDS to obtain Federal Grants to fund it…

Cory, you will be interested to know, that the Former Attorney General was in fact auditing, reviewing many of Governor Noem’s executive orders related to the Pandemic to check them, and to make sure they were constitutional, let alone did not attempt to strip people of their rights.

Cory, you will also be interested to know, that the Former Attorney General was very much responsible for winning the “Class Action Suit” against Big Pharma, latching on with other Attorney Generals to help bring back milions of dollars back to the “State” to help fight the War on Drugs.

Cory, you will also be interested to know, that the former Attorney General was the first A.G of this State that actually took the time to go out and actually hold Coffee Round House Town Halls meeting with the people directly all through out his term as A.G, he did cause he wanted to listen to them, understand what the people wanted, and to help educate the public what he was doing, and not doing as their A.G – you do not see Marty Jackley or any other A.G doing this…

The Attorney General was in fact creating coalitons with other Attorney Generals across America forcing the Federal Govt accountabel to the Constitution, this, like the Governor, is one of his functions as the A.G – create coalitions…

Mike Zitterich. It’s offensive to use Our Lord’s Prayer to promote your political views. Knock it off!
You’re right. I don’t like it and it doesn’t matter if you need it for your self-esteem crutch or not.
Putting your needs above our Lord is shameful.

Mr. Zitterich, grudznick has great, manly affection for you. grudznick is all about love and tolerance. After all, I’ve been voted the most-loved conservative with common sense on this here blogging place 5 years running.

“I, Mike ZItterich, wholy swear, do take this vow to, “Our Father, who art in heaven, hallowed be thy name…”

Hold up! What?! I‘ve been made fun of my whole life because I always believed the Lord’s name was Howard. My sister asked how I knew God’s name and I told her, “Our father, who art in heaven, Howard be thy name.” They all teased me relentlessly and still get a good laugh roughly every time we congregate.

Now Mr. Zitterich is saying I have referred to God as ‘Howard’ to find out his name is ‘Hallowed’?! Drats! Who the heck have I been rapping with all these years?! Sorry for yelling.

Mike Z, are you related to a Kurt Evans that used to post on here? The similarities are striking.

Mr. Evans is a witch. Mr. Zitterich is not a witch.

Do you fellows know what the best thing about grudznick’s friend Mr. Zitterich is, besides his fine automobile dealership?
He lives rent free in many out-of-state name-caller’s heads. Way to go, Mr. Zitterich. grudznick abides.

Just like you, grudznichts. My assistant, thinks you’re a hypocrite.
    – Well, ain’t that somethin’! This here boy named grumpnick sure is a peculiar character. Now, most folks tend to stick with their own kind, their own group of colleagues. But not groupnick, no sir! He finds himself more at ease in the company of those who think the opposite, reckon he’s a fish lost swimmin’ upstream. While others may shuffle along with the crowd and nod their heads in agreement, gropenick yearns for a good ol’ fashioned lashing behind the wood shed, where wiser minds gore him like horns in a Texas bullfight. It’s as if he’s got a hankerin’ to be criticized, not content with a simple echo chamber. Now, don’t get me wrong, it’s mighty strange, but obvious, too. He’s got liberalism living “rent free” in his head. Yes, ‘ol gripenick, the old boy who dances to the beat of a different drum and finds comfort in the arms of the enemy. He’s just a goat of a different color mucking stalls in the minds of liberals everywhere.
