Real Nurse Says Noem Could Be Prosecuted for Lying About Working as a Nurse

Remember how Kristi Noem went to CPAC in Texas last year and claimed to have worked as a home health nurse? We knew that couldn’t be true, since Noem didn’t get a degree until 2012, since that degree was in political science and not nursing, and since the only things she’s been nursing since then are her celebrity and her bad case of Coreyitis.

South Dakota Standard gets the Noem campaign to admit that Noem was not really a nurse, although the campaign still pretends that words from the Governor’s mouth have no accountable meaning:

Ian Fury, Noem’s campaign spokesman, said the governor did not work as a professional nurse.

“She helped care for a disabled older lady who was a family friend with some home health functions,” Fury told The South Dakota Standard. “She’s not claiming to be a certified nurse or anything like that” [Diane Smith, “Longtime South Dakota Nurse: Why Does Gov. It’s tough to say “I was a nurse!” without claiming “I was certified to be a nurse!” Licensed nurse Diane Smith to say that this word game, which Noem actually tweeted in 2019, is a prosecutable offense:

I then reviewed her education biography, researched the South Dakota Board of Nursing online nurse license verification registry under both Noem and her maiden name Arnold, and was unable to confirm that a nursing license for her had been issued for as an RN, LPN or CNA. I was unable to find any mention of her having attended a nursing program, practical or registered.

Having been a licensed nurse in South Dakota since 1982, it is my responsibility to know what the regulations are related to my scope of practice and to protect the public as most nurses do. I reviewed the Administrative Rules of South Dakota (ARSD), and the laws set forth by the Legislature and found that Gov. Noem’s claim to have practiced as a home health nurse as defined by ARSD is in fact considered a violation of these rules as a menace to public health, which is a prosecutable offense [Smith, 2022.09.21].

The relevant statutes appear to be SDCL 36-9-68 (for RNs, LPNs, CRNAs, and CNSs) and 36-9A-35 (for CNPs and CNMs), which say you can’t practice nursing without a license or “use in connection with the person’s name a sign, card, device, or other designation tending to imply that the person is a registered nurse” or other licensed caregiver. In her 2019 tweet and her 2021 CPAC speech, Noem seems to have used a designation—”home health nurse” that (Ian’s word games be darned) tends to imply that Noem had some sort of certification to nurse.

Noem’s legal escape here may be verb tense. She said she was a nurse. She didn’t represent that she holds a license now to provide health care. The nursing laws and rules all seem geared toward preventing some yokel off the street from walking into a clinic or nursing home and giving shots and drawing blood. As long as Noem isn’t playing nurse now, we probably can’t drag her in front of a tribunal.

But Noem might want to rein in her spokesboy’s language about “home health functions.” ARSD 20:48:04.01 specifies which nursing tasks a licensed nurse may delegate to an unlicensed individual like Noem and which tasks must be performed by a licensed professional. If Noem was performing certain home health functions, she had to be under the supervision of a licensed professional.

SDCL 36-9-28 does allow a variety of practices by unlicensed individuals. The most relevant appear to be item #3—”Gratuitous care of friends or members of the family”—and item #4—”Domestic administration of family remedies, or care of the sick by domestic servants, housekeepers, companions, or household aides of any type, whether employed regularly or because of an emergency or illness, but who may not in any way assume to practice nursing as defined in this chapter.” #3 may not apply neatly, because Noem lumped her nursing in with other paid work, implying that he nursing was not gratuitous. #4 still restricts Noem from “assuming to practice nursing as defined in this chapter,” which could be read to tie her back to that prohibition on implying that she is a registered nurse.

Whether or not Noem’s exaggeration can trigger legal punishment, it’s clear Noem has violated another ethical standard. She claimed to have worked as a nurse, yet she is not and never has been a nurse.

    Yeah, I’m willing to give her a pass on this, even though I think she’s a liar about almost everything. She should know that “Nurse” is a job title for a licensed professional, while “health care aide,” better describes what she did. But she ought to correct it on her resume.

That’s because most sell one to their mother or grandmother and are forever a pariah at Thanksgiving dinner.

    Well then, I guess I too worked as a “home health nurse.” When my parents-in-law lived with me, I administered their medications, served as their podiatrist (cut them toenails, shave them calluses and corns), gave enemas, changed wound dressings, bathed them, helped them dress and helped them change their diapers, maintained their hearing aids and false teeth, drove them up to Rapid for health care I couldn’t do, and dozens of other chores; cooking, cleaning, laundry….

    I have a life-sized picture of Kristi giving enemas to her FIL, DON’T ALL OF YOU?

    As a graduate of the SDSU College of Nursing in 1977, I believe Noem should be prosecuted to the max although chances are slim with this ignorant GOP dominated state. Over 200 enrolled in the SDSU College of Nursing, 60 of the nursing students passed the SD State Board of Nursing exam. I doubt Noem could have passed Chemistry 1.

    Noem could not have mistaken home health nurse for home health aide because they are called home health caregivers. She has written and stated nurse several times. Big difference between nurse and caregiver in education, responsibilities AND pay. Nothing on her resume prepared her for the governorship, not even her honorary degree. Was she ever vetted?

    Ohhhhhh, she didn’t include high speed racer driver or alcohol tester on her resume.
