Democratic AGs Ready to Follow Jackley’s Lead, Fight Trump in Court

South Dakota Attorney General has joined lawsuits against the Obama Administration on transgender access to school facilities, immigrationgreenhouse gas emissions, and the Affordable Care Act. (I welcome other examples that aren’t immediately jumping to mind).

Take notes, Donald Trump—you’re next:

…if Mr. Trump’s policies veer toward the unconstitutional, several of the 10 current and incoming Democratic attorneys general interviewed recently said they would apply a remedy favored by Mr. Trump himself: a lawsuit [Vivian Yee, “To Combat Trump, Democrats Ready a G.O.P. Tactic: Lawsuits,” New York Times, 2016.12.14].

GOP attorneys general began this strategy of suing the feds under Clinton but really got into it in the last eight years:

According to Paul Nolette, a political-science professor at Marquette University, who studies attorneys general, Republican attorneys general filed partisan legal briefs in only five Supreme Court cases during the Clinton administration, a figure that rose to 97 in the first seven years of the Obama administration [Yee, 2016.12.14].

Factoring in this year’s election results, I count 20 Democratic state attorneys general. Maybe they can even find some issues where Marty Jackley will join them in defense of the Constitution against a demonstrable tyrant.
