Central Point of Bosworth Case: Oaths Matter

Annette Bosworth continues to testify in her perjury trial this afternoon. Much has been said, much will still be said. Permit me to summarize a central point about why petitions matter, why oaths matter, and why this trial matters.

Leonard Waldner, minister at the Millerdale Hutterite Colony near Miller, testified yesterday that he forged several colony members’ signatures on Annette Bosworth’s nominating petition. He testified that Bosworth witnessed none of those signatures. Annette Bosworth signed that petition sheet swearing that she had circulated that sheet.

Annette Bosworth’s failure to perform her primary duty as a circulator allowed forged signatures to help nominate a candidate for U.S. Senate.

As commentator Greg Belfrage said last year, oaths matter. Oaths stop citizens from committing crimes. Oaths stop falsehood from undermining the integrity of our elections. Oaths protect democracy.

Annette Bosworth filed a false oath. Annette Bosworth deserves the full punishment allowed by the law for this crime against democracy.

    Point we’ll made Cory. Regardless of who did it, they should face the consequences of their actions. I would be very disappointed if it was someone I supported, but that’s immaterial. Bosworth committed a crime. She needs to be held accountable.

    Being a woman is not an excuse. We are just as capable of understanding election laws, the words of an oath we swear, and the penalties of violating that oath.

    The republican Dump Site has been distancing themselves from Bosworth for sometime in spite of the fact this a republican scandal.
    This trial is not over Tara, you may think the “little guy” won something today, but the reality is that the jury has not heard closing arguments and they certainly have not handed down a verdict.
    Owen, Tara is of the belief that since the Hutterites committed election fraud, it is justification for Bosworth to do so too. Which brings me to the topic at hand.
    In South Dakota republican taking oaths of any kind only consider them a ritual and that they mean nothing. Case in point is Daugaard waging war on working children by ignoring the will of the people on the minimum wage referendum.
    I don’t know how this trial will turn out, but there is one certainty and that is people circulating petitions will now be held to higher standard, thank you Cory.

    Jeff, what are you talking about? If anyone listened to Bosworth’s testimony, you are all on crack cocaine if you really believed she was lying. It is just so obvious her political handlers did not do their job. You know she is not capable of lying by her testimony. Cory can testify for that. It’s not in her DNA. Just watch the video. The honesty and naivety was impossible to hide. Testimony shows, she is not capable of lying. The Rounds Boys threw her under the bus. Anybody that trades off a $500,000 a year job to take care of the homeless and minorities? Go figure! Her heart is in the right place.

    One of her lawyers (testifying on the stand) said he had been fired as a Sioux Falls police officer for “moral turpitude”. Some might consider that to be a disqualifier for getting a Law license.

  17. Jeff, good point! Watching lawyers attack each other has been one of the lurid pleasures of the trial. Jeff Beck roused my curiosity with his dogged resistance to answering the prosecution’s inquiries into his past and his credibility. I can’t find the actual “moral turpitude” Beck kept concealing. His appeal to the Department of Labor indicates that he lost his promotion to SFPD sergeant simply because he wasn’t doing the job: slacking off, not recording his hours properly, not following orders. The defense says we can’t trust Italia Federici because she lied to the Senate and didn’t pay her taxes; can we trust Beck if he didn’t do his job for the SFPD? Is his testimony crucial?

  18. Les, I disagree. If an honest circulator had circulated the petition at Millerdale, the forgery would not have happened. Certainly, really bad people are going to keep being bad no matter what laws we pass. Laws allow us to pursue and punish those bad people. Laws also help restrain good people from giving in to temptation. Election laws establish clear rules for everyone to follow. Oaths and laws are not useless.

Review the strange thing she said to me about being “sorry for the things that happened to you as a child,” concocting a strange and false story that awful things happened to me as a child.

    Dr. Bosworth lies.

    Now chill out, Tara. Bosworth supporters like to say I’ve hyped Bosworth far too much, but the hype comes from you, Waldron, and Bosworth herself, who blow her case into party politics and massive conspiracy, which sensationalism only serves Chad and Annette’s basic pickpocket tactics: Keep people’s attention on something else while we lift their wallets.

    Annette Bosworth’s attorney, Bob Van Norman said that for the first time in 37 years he has ever seen a judge grant immunity to a witness. The state said if Jeff Beck testifies against Joel Arends, they will prosecute him (Jeff Beck) for not reporting the crime that he witnessed Joel Arends committing. The judge made a very BOLD move to grant Jeff Beck immunity. Jenny………… your bashing Bosworth party is over! OK does anybody have the guts to post that video??????????????????

    The courtroom oath carries little value in many cases. We just watched a family dispute and the lies permeated the courtroom with the judge giving no attention to the attorney breaking down the witnesses truthfulness.

    My mom told me a lot of things about lying when I was little. I guess it was because I was always trying finagle a way out of taking responsibility for something I broke while throwing a ball in the house, or some such thing. My mom told me that I shouldn’t lie, because I was no good at it. As I grew older, I tried to get better at it, but, you know, I realized she was right. I was no good as poker, either. Just to show you how extremely bad at lying I am, I generally apologize on blogs when I’m wrong, because I’m uncomfortable with people thinking I’m trying to bullshit them, although sometimes I do bullshit just to see if I can get away with it (sorry, Mom). Bullshitting is different than lying, see, but not much different if you are really truthful about it, which I mostly am, most of the time, anyway.

    I don’t understand people like Bosworth, who lie, and then believe it. What’s the George Costanza line, “It’s not a lie if you believe it.” I can’t do that. I can lie, but there’s something in me that won’t allow me to believe my own lies, and it comes out in some way that my mother could always tell. I guess I learned early to tell the truth, mostly, because I wasn’t a good liar.

    When Dr. Bosworth testifies truthfully on the stand that she lied when she signed the petitions – and that she knew that she was lying when she signed the petitions, and that she understood that at the time – and did it anyhow – that is the only thing that matters in this case. Whether or not her attorney advised her to do so is irrelevant (despite the defense’s attempts to make it relevant).

    This is not the first time Bosworth has been confronted by the Attorney General’s office at a hearing to determine her future. The AG’s office also presents the cases before Medical Board Hearing Examiners, where stipulations have been placed on Bosworth’s practice of medicine. Among those stipulations were that she place herself under the care of a psychiatrist and a licensed clinical psychologist. Her erratic, ego-driven behavior was the issue. That issue resurfaced during her campaign for the Senate candidacy with its land auctions (which appear to be fraudulent), the specious accusations against her opponents which took up the positions of the most extreme right-wing conspiracy theorists, the strange exhibitionism she displayed during her campaign, her constant dissembling when questioned by the media, and her treatment of employees and retaliatory accusations against her critics.

    The issue of whether one who has the attentive intellect to complete a medical education and certification is so careless, unaware, and negligent when it comes to meeting the legal requirements of nomination petitions is what the jury will have to work out. The elements of the social media which have come to her defense are among the least credible and in their efforts to discredit Marty Jackley’s office have given it some unintended support. The legal wrangling over attorney testimony is irrelevant to what the jury is asked to decide, which boils down to whether Bosworth is as “innocent” and persecuted as she now claims or whether she is posturing. Whatever the jury decides, the Board of Medical Examiners will make decisions about whether Bosworth’s mental state is a concern to the medical profession.

    Well guys, then I guess Dr. Aanning doesn’t know what he’s talking about when he said “They” are out to take away Dr. Bosworth’s license to practice medicine….and the election petition was their lame excuse for prosecuting this doctor…..the attorney general’s office is being pushed to proceed by those who appointed him….since the attorney general’s office is the legal arm of the licensing board (SDBMOE), and since every member (including the physicians) of the SDBMOE is hand-picked by the conflicting relations between all the protagonists supporting the prosecution……the totalitarian mind-set of the prosecution has virtually silenced the supporters of Dr. Bosworth.

    The first big Lie Bosworth told was about her campaign platform, recall if you will that Democratic campaigner Steve Hildreband (Bosworth hired him and she still owes him $23,000) stated emphatically that the Bosworth’s position on abortion was opposite of what her campaigned adopted.

    On the Belfrage show she consistently referred to Cory as an out of state blogger when it was widely know Cory was blogging from out of state while his wife received continued education.
    Did Cory ever give up his state residency or voting rights? No and Bosworth knew it. Another lie from the Annette lie file.
    As Cory goes through the Bosworth testimony and the Belfrage interview he will be able to reveal more.
    In defense of Bosworth, she lies so damn much she doesn’t even know that she’s is doing it, it is part of her DNA.

    Oaths do matter. We took an oath to uphold the SD constitution as do all public servants. Yet legislators trample on our SD constitution all the time. Daugaard ushered in Obamacare and common core, both if which required him to disavow his oath of office. When Stace Nelson, I and others tried to stop the horrible anti scholarship bill because it addressed 5 subjects instead of only 1(HB.1234), the governor and others cut us off at the knees for meddling in HIS bill. That in itself is another breach of our constitution. ..the executive branch is restricted from writing bills and they do it all the time. . The oath if office means nothing to Pierre….when Val Rausch was Speaker , he even refuse to add, “so help me God” when he took or gave the oath

    Lora agrees with us completely that oaths matter. Feel free to prosecute anyone else you see violating oaths. Be sure to include Bosworth in that punishment, because we have the evidence and have had it since March 26, 2014.

    Remember, the deep irony here is that a registered Democratic blogger got the Republican Attorney General to investigate and indict a Republican Senate candidate.

  51. But let’s not let Lora sidetrack us. She is speaking of the general oath elected officials take to uphold the Constitution, then trying to drag us all into an argument that hinges on interpretation of law. Bosworth perjured herself by swearing an oath that she performed a very specific action that she did not perform. I need no legal interpretation to prove that Annette Bosworth did not circulate the six petition sheets in question and that each signer did not personally sign those sheets in her presence. Recall the oath:

    “I, under oath, state that I circulated the above petition, that each signer personally signed this petition in my presence,…”

    Lora’s argument sounds like Charles Haan’s lawsuit against Rep. Kristi Noem, based on his allegation that she had violated her oath to uphold the Constitution by taking certain political positions. The judge dismissed Haan’s lawsuit because it was a political argument against legislative actions that enjoy sovereign immunity. A judge can’t remove a legislator for legislative actions.

    The Bosworth prosecution is not a political argument. It is an argument of fact. That’s why Bosworth is in court and Rausch never will be, at least not for what Lora offers to distract us.

Video #3: pretense that Bosworth is “innocently naïve” and a new Huey Long facing persecution more vague assertions with no evidence, and the same over-the-top claim that Dr. Bosworth’s life hangs in the balance. What the heck? How about I end every blog post by saying, “My life may depend on your sharing this blog with as many people as possible”? People would laugh at such a spurious claim. Get real: in what way is Bosworth’s life threatened by our not sharing these videos?

    Video #2: Again, B.S., showing no way in which Jackley harmed Bosworth’s campaign. The unleashed “full power of the Attorney General’s office” didn’t cause Bosworth to get under 6% of the vote instead of the much larger share she’d have needed to beat Rounds’s majority win. No evidence supporting the assertion that every other state in the nation would ignore the swearing of a false oath. Same absurd claim that Bosworth’s life hangs in the balance.

    Video #1: same vague assertions, same warning that Bosworth may die if we don’t share the video. This isn’t even creative political theater; it’s YouTube glued to a crappy old chain letter: “Send this message to ten of your friends, or this cute little girl will die.” Good night, let’s avoid stepping on cracks in the sidewalk while we’re at it.

    Tara, I am disappointed that you can’t see through such propaganda. Peter Waldron is offering us no new evidence, no new understanding. He’s just recycling the smokescreen kicked up by Bosworth during her campaign and blown further after her arrest.

    The integrity of the electoral process is critical in our Democracy. This may be a good time to turn yourself in and further demonstrate your blind faith in Annette Bosworth. How many did you not witness? Which campaigns?

    Tara you signed off on a contract which is the 2nd largest purchase most people will make in their lifetimes and you didn’t read the contract? Then you try to equate it with Bosworth trusting her attorney on the rules of petition gathering? This is one of the many reasons you should not hold any public office including the Mitchell School Board. Annette Bosworth clearly showed from this petition fiasco she is unfit for any public office either.

    Chris Nelson former SOS in testimony went into great lengths how that office did everything they could to help simplify and explain the petition gathering process and how important it was. A pamphlet goes out and the instructions are on each petition. It’s actually very straight forward. There should be no excuses and not following those fairly simple instructions is simply being lazy blowing off the law and the oath they took.

    Political positions whether a local school board or Senate requires reading studies, reports or proposed laws or rules to name a few of the important responsibilities that elected position requires and if they cannot comprehend and follow the rules of a petition or just blindly sign a contract they certainly should not hold any elected office looking out for taxpayers.

    I fail to understand why there is any issue here. This is about one thing that is pretty simple and clear cut: Did she, or did she not witness the signatures?

    I believe one of the aspects of narcissism is creating one’s own reality. Bosworth seems to be highly skilled at that. Tara is working on it.

    Tara and now Lora are working awfully hard at throwing all kinds of feces at the oscillator, trying to get something to stick, regardless of how tangentially connected. Or not at all.

    This is one of the strangest comment sections on DFP that I have read in some time. It fairly Sibsonesque: A steady chorus of sane voices pointing out obvious facts repeatedly. An argumentative voice that continues to return to its own, personal reality, and trying to universalize that reality. For a while this was entertaining, but the bloom is gone and it’s become tedious and boring.

    Some posts were acknowledged “Sibby-bait”. Now we have “Tara-bait” and the results are similar. Sigh.

    May God help the citizens and those poor other school board members in Mitchell, SD if Tara Volesky and/or Steve Sibson somehow get elected Jun 2nd. More than likely they will be decidedly defeated once again but if for some itty bitty chance one or both get elected it will be non-stop rabbit hole after rabbit hole hijacking school board meetings.

    It doesn’t matter what the article says regarding your being a candidate for school board or when it’s Steve Sibson’s time to be featured as a candidate. As a Mitchell voter I feel both your past history of actions disqualify either of you from ever being fit to hold a public office.

    As mentioned before you admitted to not following the instructions and Oath of a petition numerous times or even reading over a contract when purchasing the 2nd highest financial purchase most people will ever make. If you don’t read and comprehend instructions, a basic contract and even what is posted as factual numerous times on this blog and in court how would you ever be able to function being on the school board?

    Again I see school board meetings being hijacked going from rabbit hole to rabbit hole from complaining about “power brokers”, Neo Marxist New Age Agenda, Annette Bosworth this, Marty Jackley that, The Democratic and Republican Party establishment secret alliance to a guest speaker Lora Hubbel brought in to talk about banning vaccinations in schools to chemtrails. Then telling us that pot smoke was in the halls all the time at Mobridge High School so what’s the big deal? Your for full legalization so what’s wrong with Mitchell kids smoking pot? “Think for Yourself!” Remember?

    The elections in Mitchell have more to do with the qualifications and positions of individual candidates and not any political party affiliation.

    If any of you two somehow eek a win my empathy will be for those other board members and citizens of Mitchell. Residents of Mitchell June 2nd please DO NOT vote for Tara Volesky or Steve Sibson!

    Has anyone else ever notice the pattern of Tara’s debate?
    First she seriously deviates from the topic of the thread, she could not contend with the facts of the Bosworth trial and lost that debate.
    Next she inserts herself and her political ambitions into the debate (i.e. school board race) and starts campaigning for herself.
    Finally when she figures out that she cannot convince one person here about how great she is, she attacks people for not posting under their real names, which essentially losing that argument as well.
    Lynn happens to be a well spoken dedicated Democrat and is not Weak!!!!

For that last decade, Bosworth has acted as if regular rules don’t apply to her, as if she can do whatever she wants because she is better than everyone else. She can cheat Medicaid because she’s saving lives. She can dress inappropriately and parade through the Sanford lobby in her bra because she’s fighting Big Medicine. She can lie on a nominating petition because she’s fighting Big Government.

  88. Roger, your critique is spot-on as well. Nothing in Tara’s attacks has refuted the observation of the original post: oaths matter because they protect the integrity of elections. Bosworth undermined public trust in the electoral process by swearing false oaths and failing to carry out basic due diligence.

    Personally, I don’t read this blog because Cory is a Dem. I read this blog because, whether I agree with Cory or not, he always tells the truth. He is a shining example of true investigative journalism. I was a life-long Dem who changed my registration to Independent in 2010 when the SDDP allowed John Thune to run unopposed. It was my own private little protest. I renewed my license this month and changed my registration back to Dem. Why? Because Cory has inspired me to rejoin the Democratic party. If Tara was really interested in sticking with the issues, she would not have hijacked this blog and turned it into the Tara For School Board Traveling Medicine Show. I have little respect for her passive aggressive responses to anyone who does not agree with her.

Pat’s choices are regularly skewed by his politics, bad judgment, and agenda of character assassination. Consider his own flip-flop on Bosworth and Haber: when they were tools he could use to attack me personally and to drown out the Stace Nelson challenge to Mike Rounds, Powers was more than happy to support her. When she started to attack his Republican patrons, Pat did an about face. Like Bosworth, Pat uses words as tools for his own ends, not as vessels of meaning in a search for truth and understanding.
