One of South Dakota’s medical cannabis suppliers is suing the state for an allegedly improper inspection that put the business in peril.
In a Facebook post yesterday, 605 Cannabis says the Department of Health inspected its Worthing facilities on January 19. The Sioux Falls area had another significant snowstorm that began January 18 and tapered off on the morning of January 19. 605 Cannabis closed its Worthing shop on the 19th, but apparently Department of Health inspectors still managed to ski out to Worthing and identify 19 violations of state law and administrative rule. “In conjunction with the Report,” says 605 Cannabis, “the Department issued an Emergency Order claiming certain ‘serious’ violations posed a risk to the health and safety of the public, and as such the Department was authorized to initiate an emergency suspension of 605’s manufacturing and cultivation licenses. The Department also requested 605 recall certain products and advised 605 of its intent to permanently revoke its cannabis licenses through administrative proceedings.”
The DOH Medical Cannabis Program announced the voluntary recall on February 10 and posted additional guidance on February 17. 605 Cannabis insists its products are safe. The company says it has filed suit against the state in circuit court in Lincoln County (case #41CIV23-214, for those of you with access to the courthouse) alleging the DOH conducted an improper inspection and is “attempting to enforce un-promulgated rules”.
The Department says it cannot comment on pending litigation.
Looks like a “swatting” where selective enforcement is an exercise in political retribution. Expect to see more of this crap from South Dakota’s vindictive law enforcement industry. Thank the Wakíŋyaŋ for tribal cannabis.

The State of South Dakota also has very strict requirements for medical marijuana facilities, including such things as the doors, bars, on the windows, surveillance systems, bar coding of plants and tracking the plants from seed to sale. So tell me, how did this train wreck business even get off the ground.? Their facility does not even meet code, yet somehow they got a pass on that. It is dirty, there are kids running around in the building, a real sloppy mess. Then she sells edibles that somehow pass state testing…then the state says oops…and recalls the stuff…..and the honest dispensaries that bought her garbage are stuck with stuff they can’t sell and she walks away with the money. Time for a class action lawsuit against 605 lending, so the other businesses who do play by the rules can recover some of their losses with product they bought from her and couldn’t sell and having to also go through re-testing which resulted in additional lost income, all because of one bad apple in the barrel.
