Citizenship-Paperwork Requirement Already Denying South Dakotans Right to Vote

South Dakota’s version of the SAVE Act, Senate Bill 175, has already denied nine people in Lincoln County the right to vote:

Kayla Delfs, election coordinator with the Lincoln County Auditor’s Office, said the office had received 10 voter registration applications as of March 7 that were missing the necessary documentation to prove U.S. citizenship as required by the new law.

One person emailed proof of citizenship, but Delfs said she has not received documentation yet from the others after mailing notification of the problem to them. Those voters will be registered as federal only voters until they provide proper documentation — a new voter status signed into law in 2025. Federal only voters can vote in presidential and congressional races, not state and local races [Makenzie Huber, “Calendar Quirk and Law Change Have South Dakota Election Officials Worried About Deadlines,” South Dakota Searchlight, 2026.04.09].

Denying even a single South Dakotan the right to participate fully in elections is a grave error. Legislative and gubernatorial candidates seeking liberty and justice should campaign on repealing SB 175 and returning South Dakota to a philosophy of making it easier, not harder, for everyone to vote.

    Fueled by Trump’s racism US Immigration and Customs Enforcement and Border Patrol agents have wrongfully stopped, detained, and interrogated Native Americans during raids even though they are US citizens and because of the unlawful treatment of Indians activists are calling for documentation to be carried for protection.

    Chair of the U.S. Senate Committee on Indian Affairs, Lisa Murkowski (R-Alaska), is voicing opposition to the SAVE America Act, legislation being aggressively pushed by the Trump administration. For Indigenous voters, she said, several provisions in the SAVE Act would pose significant challenges. While tribal identification cards may be accepted for voting, she noted they would not qualify for voter registration. She also cited the long distances to travel to register to vote would prevent some to do so. The law, which requires proof of citizenship for federal registration, invalidates many Tribal IDs, creating severe burdens for rural Alaskans, say advocates, noting that only six election offices exist in the state.     I see they are starting automatic draft registration this year. So why can’t they do the same with voter registration?

    BTW, a regular South Dakota driver’s license will not do to register to vote if the SAVE Act passes. Here in South Dakota we have “Real ID”, but to satisfy the Federal SAVE Act, you need an “Enhanced Driver’s License” with a flag on it, not a star. Only 5 states offer those in the entire country:
    New York, Vermont, Washington, Michigan, and Minnesota.
    Funny how the GOP requires an ID that 45 states don’t issue…
