EB-5 Lawsuit Lawyer Neglects to Pay New York Registration Fees

As expected, the 35 Chinese investors who are suing South Dakota and its EB-5 visa investment czar Joop Bollen for tricking them into investing in the doomed Northern Beef Packers slaughterhouse are bringing high-powered Manhattan lawyers to argue their case (#32CIV15-000312)…. or are they?

New York attorneys Bruce Robins and Ezio Scaldaferri of Feder Kaszovitz LLP have submitted motions for admission pro hac vice to argue their clients cases here in South Dakota. Mr. Robins hasn’t raise any eyebrows, but Mr. Scaldaferri gave Bollen’s legal team at Aberdeen’s Siegel Barnett & Schutz an easy shot when they discovered on January 6 that, contrary to the claim of his pro hac vice motion, Mr. Scaldaferri wasn’t actually registered to practice law in New York:

Holy cow! Ezio’s not a lawyer? Ezio, your cousin told us you was legit!

So Ezio comes running down the sidewalk, waving a fistful of quarters over his head and shouting, “Officer! Officer! Don’t tow my law license!”

“Delinquency”, complete with mock quote marks, due to “certain outstanding fees” (those are my mock quote marks)? That’s delicious, Ezio, almost as delicious as Joop’s delinquency for certain outstanding bank franchise taxes. It’s good to see you understand the mind of your opposition.

Don’t underestimate your opponents, Ezio. Joop and friends didn’t get rich on EB-5 by being stupid. Bollen’s Aberdeen lawyers and the state’s legal squad have plenty of statutory arguments to make against the LP6 Claimants’ lawsuit (stay tuned for those details in an upcoming post!). The LP6 Claimants can’t afford to have their lawyer make amateur mistakes like not paying his registration fees back in New York.

    Those 35 Chinese investors need an attorney with a track record of rolling with the punches and staying on top of international trade. I recommend Mr. Goodman. Better call Saul!

    OJ had good lawyers too. Hope they are able to look into Sveen’s machinations. I would think he is a witness. Joop and Sveen are fighting for their lives, so to speak, imo. The investors might be getting taken at every turn. Ah, the good old USA and its heartland. This is the state that is throwing out the name-change law ’cause the Indians used it!

    I used to play a song written by lawyers years ago called “California Prick”. Think I’ll ask ’em if a I can modify the name to “South Dakota Pric…s.” Will add a new verse too:)

    imagine all the fun we can have if the state and sdrb have to answer a few rounds of interrogatories and depositions.

    maybe their money would be better spent on hunting accidents and fires…than a team of lawyers… i mean at this point nobody would care.

    i mean if a group of ppl took 70m from the mob or more i dont think they would send lawyers after ppl.

    Daleb, that opportunity for discovery is one of the big reasons we should hope the state’s motion to dismiss doesn’t fly. If the Chinese investors’ lawyers pass this hurdle and get their hands on documents that they can enter into the record, I’ll have to hire a second writer to handle all the blogging that will ensue.
