Holy cow: did Gordon Howie just break some real news? In his latest blog post, Howie posts images of what appear to be an August 11 indictment of Chad Haber on two felony counts related to his falsification of his circulator’s oath on his wife Annette Bosworth’s U.S. Senate nominating petition in 2014 and an August 13 summons for Haber to appear in Hughes County Court on October 26 at 10 a.m.
The summons is signed by Judge John L. Brown, the same judge who sentenced Bosworth in July after a jury convicted her of twelve counts of perjury and filing a false instrument.
Howie, faithful to previous flacking for the felonious fakers, suggests the indictment of Haber, who “ran” as a Libertarian against Attorney General Marty Jackley in 2014, is further evidence of the GOP establishment’s selective enforcement of election law to punish political enemies. Faithful to my own suspicions, investigation, and findings, I will counter that an Attorney General looking to grind the bones of a political enemy wouldn’t have kept silent about the indictment for eight weeks. (The A.G. may simply have been waiting for the defendant to receive notice that he was on the hot seat: notes at the bottom of the summons indicate that it was not served until Saturday, October 3, at 5000 S. Minnesota Avenue in Sioux Falls, the site of Haber’s office for Preventive Health Strategies and his wife’s supposedly shuttered Meaningful Medicine clinic.)

Update 12:01 CDT: An important correction! Gordon Howie says that the Attorney General is targeting Haber with this indictment. Technically, that is incorrect. When I checked the actual and complete indictment on the courthouse database, I found Howie failed to include the second page of the indictment, which shows that the charges were brought by Hughes County State’s Attorney Wendy Kloeppner and Deputy State’s Attorney Graham Oey. The Haber indictment is a Hughes County indictment, not an indictment from the Attorney General. Hughes County is likely the prosecutor in this case thanks to what A.G. Jackley’s assistant Jeromy Pankratz explained here in Aberdeen last May: A.G. Jackley handed off investigation of Haber to deny the Haber-Bosworth hangers-on any chance to allege conflict of interest or political retribution. One can still argue that the Attorney General and state’s attorneys are head and tentacles of the same inky squid, but on paper, this prosecution is Hughes County’s baby. I have amended my text here to reflect that fact.

Haber will be lucky if this petition transgression (which readers of this blog helped discover in March 2014) is the only charge on which the state tries to hang Haber. We have seen evidence that Haber defrauded raffle ticket buyers, ripped off a woman who loaned him $200,000, engaged in unethical behavior that drove staff to quit his wife’s campaign, was delinquent on Utah taxes, falsely accused me of theft, and as of this morning still has not filed the campaign finance report that was due October 24, 2014. If there is any selectivity in enforcement of laws, it’s that the authorities did not take legal action against Haber sooner, on a much broader array of charges.
Howie wonders if A.G. Jackley (whose office, again, is not actually the prosecutor here) views Bosworth and Haber as Bonnie and Clyde. In that wondering, Howie may finally be on the right side. Bonnie and Clyde both committed crimes, and both had justice coming. So does Chad Haber.

Obviously not paying attention: denial didn’t work out well for Annette.
Oops: now the story sounds inconsistent, suggesting there is justice to be done by charging and trying Chad. The former A.G. candidate also demonstrates his unfitness for the job he pretended to want last year. The state has moved very cautiously. They tested the charges on Annette first, established that they could win a case like this with the evidence available, and now can turn confidently to prosecute other petition perjurers. If the Bosworth case had flopped, the Hughes County state’s attorney likely would not have advanced this case. This one-at-a-time approach can still achieve justice, with the added benefit of not gambling state resources on two uncertain prosecutions at the same time (plus maybe some savings now in having road-tested a case like this and knowing exactly which arguments to go for and which to avoid).

I simply report the alignment between current facts and what I reported in May after the meeting with Mr. Pankratz. I accept that the A.G.’s office has handed off this prosecution to avoid insulate the case about as far as practically possible in our small state from exactly the tired allegation of Retribution that Haber recited on TV tonight.
I also posit that prosecuting Haber has everything to do with punishing violations of the law and nothing to do with any need to whack a dangerous political enemy. Haber left to his own devices poses no viable political threat to any South Dakota politician’s power.

Damn good question. The contract language printed in black ink in Item No. 6 of the MSD 17-2 employment contract for Supt Joe Graves is clearly stated in precise language requiring no inferred interpretation.
Supt Joe Graves was moonlighting when he was issued a contract by Mid Central Education Cooperative that paid him $157,500 of compensation to provide administrative services in overseeing the educational program funded by two US Department of Education “Teaching American History” grants. TAH Director Joe Graves was the administrator who oversaw the educational program that assisted history teachers statewide secure master degrees from USD and DWU.
Doing so breached the terms and conditions specified in Item No. 6 of the MSD 17-2 employment contract for Supt Joe Graves. Perhaps, a community action group of MSD 17-2 property tax payers needs to file civil action naming Dr. Joseph Graves as an individual seeking $157,500 of incurred damages which would be returned to the coffers of MSD 17-2.

The chain of command within state governance says, SD SOS Krebs asked SD Attorney General Jackley to investigate and determine whether Mr. Haber committed criminal acts violating election nominating petition statutes. The same chain of command indicates that SD SOS Krebs would need to ask SD Attorney General Jackley to investigate and determine whether: (1) Local and/or state officials having rigged or attempted to rig a public election in South Dakota; and (2) Subsequently, Local and/or state officials corruptly covered up such election rigging acts.
As 20-year retired veteran and lifetime citizen of South Dakota for 57 years, I herein respectfully request that SD SOS Krebs submit a formal request to SD AG Jackley asking his office to investigate and determine whether local and/or state officials rigged or attempted to rig the 2012 Davison County primary election with local and/or state officials subsequently covering up the facts contained in the SD SOS’s 2012 Davison County Ballot Task Force Report.
SD SOS Krebs and SD AG Jackley, if memory serves me correctly the words are “freedom, liberty, justice and equality for all”; not just for a favored few.
